LAHORE: The head of Pakistan’s leading body of Muslim clerics Tuesday came to the defence of a young Christian girl accused of blasphemy, demanding her case be handled fairly and impartially.

Allama Tahir Ashrafi, chairman of the All Pakistan Ulema Council, said if Rimsha, accused of burning papers containing verses from the Quran, were found to be innocent, her accusers should face justice.

The cleric said protesters who demonstrated to demand punishment for Rimsha, who reportedly suffers from Down’s Syndrome, were following the “law of the jungle”.

Rimsha has been held since August 18 under the strict blasphemy laws, prompting concern from Western governments, the Vatican and rights groups.

On Monday Rimsha was taken from prison to hospital for tests to determine how old she was, a senior doctor told AFP, after conflicting reports about her age.

Around 120 uniformed police officers guarded the hospital, the doctor said.

Ashrafi urged the government to take action to protect Christians in the poor Islamabad suburb of Mehrabad, where Rimsha lives, and encourage Christian families who fled in fear after the incident to return.

“This is inhuman that those who have nothing to do with the case or are not a party to it are also being harassed,” Ashrafi told AFP.

“It is just like the law of jungle that 500 people approached a police station and got a report forcibly lodged with the police.”

Ashrafi said Rimsha’s case should be a watershed for Pakistan’s blasphemy laws.

“We demand an impartial and thorough investigation into the case. Strict action should be taken against all those accusing the girl if she is found innocent,” he said.

“The government should make this case an example so that nobody will dare misuse the blasphemy law in future.”

Rimsha's mental age below true age, says medical report

According to a medical report seen Tuesday by AFP, the young Pakistani Christian girl appears to have a mental age below her true age and to be “uneducated”.

A panel of doctors examined Rimsha on Monday to determine her age, which had been the subject of some dispute.

The medics’ report said that based on factors including her height, build and teeth, Rimsha appeared to be “approximately 14 years”, and gave details of her apparent mental abilities.

“She appears uneducated and her mental age appears below her chronological age,” the single-page report said.

Rimsha’s lawyer Tahir Naveed Chaudhry said they had applied to have her case proceed under juvenile law.

At a brief hearing in the case on Tuesday, Judge Raja Jawad Hassan adjourned proceedings until Thursday after defence lawyers submitted a bail application.

Blasphemy is an extremely sensitive subject in the nation of 180 million people, 97 per cent of whom are Muslims, and those convicted of defaming Islam or desecrating the Quran can face life imprisonment or even the death penalty.

Human rights activists claim the laws are often used to settle personal vendettas and last year two prominent politicians were assassinated apparently for speaking out against the legislation.

You are saying "shame on all muslims". Mind your language. Do you know what is a Muslim? All the prophets are pure Muslims. Actually you people do not have any knowledge nor you have any religion. You can just abuse. There are good people in every religion and in every country and also there are bad people.

Don't agree...One can perhaps even have such a silly law...The question is why is this one sided? If a Muslim says bad stuff about other religions (or their prophets), say Hindus, then why cant the Muslim be persecuted in the same way? Its a one sided law made to make undermine minorities under Islamic Law or Shariah.

This case is giving Pakistan a bad name; moreover, it is giving Muslims a bad name too. Only few individuals will have views that support Rimsha's imprisonment; however, this case has created a negative vibe overall. Sharing articles on facebook regarding this issue had led to angry messages from my Muslim 'friends' in inbox demanding to remove said posts. I personally found this very demeaning. It is good to see a positive message coming from the Muslim community too, which restores my faith in humanity.

ZEN - the Blasphemy Law is not a black law because you know that in India and Europe burn holy Quran in public and also make cartoons of holy prophet (s.a.w.w.). Similarly U.K. has also made Blasphemy Law so nobody can disrespect holy prophet Jesus Christ who is equally respectable by the Muslims. However, misuse of the law is unforgivable crime and the little girl must be freed without waste of time.

In a country where unjustice is everywhere and lawlessness is an everyday norm, how do you expect them to do justice?. most of the muslms are muslm by names only (traditional muslm born in muslim families only)prophet Muhammad (pbuh) tell us to forgive and here we are doing the opposite. Lastly deprived communities along with minorities are the main target of thse so called mullas . it is shamefull act and they should be ashamed.

Dear Sonya, Allah Almighty Subhanhutaala has given wisdom to people to decide in the right direction in the light of holy Quran, followed in true practice by His holy prophet salal lao aleh wa salam who says love to humanity as Allah loves more than 70-mothers of a person. Prophet says children are innocent by birth, if any child will die in his/her childhood irrespective of any religion, it will directly enter ihto Heaven without any question by the angels so if there is any true Muslims, they will never demand punishment for a 14-years girl. The demanding people will surely enter into Hell for their injustice.

It is so simple, if she has down syndrome it's done the law shouldn't even apply to her, what's next a 2 year old rips a page? And the accusers, if they are found guilty they should be punished accordingly. It's obvious that the current government likely wants to make amends in the blasphemy law, so they'll likely use this to there political advantage to get enough support to start making amendments, slowly but surely there probably objective is to rid of it (that would take years of course). But hey, the more you forsake the more you'll be forsaken.

Also please find out who threw the holy papers in the garbage first place..its not that person committing blasphemy according to this law or this girl who is actually unknowingly burning which in turn is doing favor to all muslim by burning it .Because thats the correct way to dispose old holy papers She should be rewarded not punished: Can somebody in pakistan print my comment in urdu and give it mullah who declared it throuh loud speaker...

Why don't they let Allah defend himself? If he is Allah, he doesn't want men to defend him and make more injustice. Allah should have mercy on a litle girl who doesn't even know how to read. A god should be a god and not depending on men to make justice for him.

The blasphemy law should be repealed.Prophet Mohammed never punished those who insulted him.I don"t think there is such a law in any other Muslim country.Prophet Mohammed went to inquire about the well being of a tormenter when he noticed that that person that day or for some days had not tormented him.Surely in his times people insulted Quran but they were tolerated and there were dialogues and Quran is defended by Allah. It is in hearts of followers and Will be respected by non believers also by good, noble, kind practices of Muslims not by the misguided behaviors of ignorant and in fact selfish mullahs who are distorting the religion for thier power and control over ignorant masses. You are right. Islam has survived and flourished for more than 1400 years without any blasphemy laws. Islam and Quran do not need our protection to survive. If someone burns a paper on which quranic verses are writen, it is not burning quran, because quran still lives in practice. Blasphemy laws of Pakistan are an indicator of how naive Pakistani people and government are.

Allama Tahir Ashrafi has done an excellent Job, showing the true spirit of Islam, of tolerance and Justice. This case should be treated totally based on Justice. Common people have no right to punish other if we follow the law of the country.

Please, just let her go, and quickly. Please, the whole Pakistani nation, think of the damage which the charges, and the tension and imprisonment, cause to the mind of this fragile, innocent minor child, with probably a Down-syndrome (a birth-defect). She and her family need protection, and psychological and medical care and support. And, most probably, help in migrating now to somewhere else to live. Will the accusers ever let them to live in peace, or will there be a revenge? This case is absurd - even now this poor child faces court proceedings - due to having burnt something = newspaper from garbage! She cannot read (Arabic), nor would never know what is from the Holy Book Quran. -- What has happened to the judicial system in Pakistan, because it accepts to handle such nonsense? Everyone in their right mind - as all the comments show - wants this innocent child to be set free, and the Christian community protected, and allowed to live in peace. They do no harm to others. As someone very rightly says, please, do not mix NATO and the US with the poor Christians in Pakistan. And, this is a child with a Down-syndrome birth defect, who needs special protection in any case. Rather, this case should now be turned around to educate people in Pakistan of the needs of people with disabilites - of all kind - for medical and psychological care, and attention. That is an area, which is totally neglected in Pakistan, and hardly ever even talked about. But, please, as Allama Tahir Ashraf basically says: "Stop now this nonsense concerning this innocent child, and the poor Christian community in Islamabad". Government protection for them, and this child free immeaditely without any court trial, and with medical and psychological help, and protection to try to undo the trauma now caused to her, and her family.

It was a grave mistake by the family who left back the Holy pages. The little girl is not at fault. Imagine her plight of facing the blasphemy law. Punishing an innocent (and that too mentally unstable ) girl is surely not the teaching of the Holy Quran, and our Prophet (SAW). Such 'over' acts of some people is causing much malice to the name of Islam. May Allah give taufeek to everyone to understand the teachings of the Holy Quran and follow the path of our Prophet (SAW). It is heartening to see so many voices (Pak and Indian) for the little girl.

So this other Mulvi says ..... if Rimsha, accused of burning papers containing verses from the Quran, were found to be innocent, her accusers should face justice. ..... He should have said " irrespective Rimsha innocent or not, he would willingly give his neck for her freedom. " Islam is destined to be confined to a nationalist religion of Arab land, every other place of any muslim bearing is just a lost world imploding within itself.

S. Khan, It is the shame for Pakistan as nation. Even if that girl is not sick, she was just collecting garbage. Please free this innocent girl, and i request all Pakistanis and Dawn newspaper to publish this on their main page that as muslims we should respect all religions and all nations. We are all human being first. As a nation we should learn something from western nation like North America and Eurpose where everyone has the freedom of the religoin and i think that's why they are blessed more than us. We should protect our Christian or Hindu brothers and make them feel that Pakistan is also their country and we will protect them.

Goran Dimeski; If the events are as you described, indeed there is no case against her. That is why there should first be an investigation to establish the basic facts. My concern is that a real investigation would be squashed by the shrill voices of Islamic and anti-Islamic bigots and the charge of the Baniya Brigade. Some people are obviously trying to confuse the issue by bringing in facts, frivolous at best like a free Iftar in Canada by one Mr. Iqbal. frankly Iqbal sahib, I am not selling my Quran for a free Iftar.

Fairness for an 11 year old, especially if she has the purported medical condition is to let her go. We should however leave no stone unturned to determine if she was used as a tool by some other forces. With as popular as Quran burning is in the West, this is not beyond the realm of possibility. We cannot accept Quran burning as a quid pro quo just because some students got a free Iftar in Canada.
