The most recent suo moto action taken by the Chief Justice of Pakistan happens to be against one of his own sons, Dr Arsalan Iftikhar, on alleged reports that he sought favours from one of the biggest business magnates of Pakistan, Malik Riaz Hussain.  Dr Iftikhar is not new to the controversies and was previously brought into the limelight during 2007 when Pervez Musharraf filed a reference against his father before the Supreme Judicial Council.  The reference stated various allegations against Dr Iftikhar, however, none of them was proven to be true during the famous trial of chief justice.

The Chief Justice of Pakistan, Iftikhar Muhammad Chaudhry, was suspended by Pervez Musharraf in March 2007, on various charges pertaining to corruption. According to the reference filed against the chief justice, one of the charges levelled against him was that he allegedly committed misconduct by employing his position to gain undue advantage for Dr Arsalan Iftikhar, his son.

The bizarre reference filed against the chief justice stated that Dr Iftikhar secured an overall C grade in intermediate examination, which was not sufficient to grant him admission in Bolan Medical College, in 1996. It was alleged that the then chief minister of Balochistan was approached to nominate Dr Iftikhar for admission against leftover foreign vacant seats/special seats.

According to the reference, nine years later, Dr Iftikhar was appointed as a medical officer at Institute of Public Health, Quetta in 2005. A few days after his initial appointment, the chief minister of Balochistan passed an order, which called for Dr Iftikhar’s promotion as section officer in health department.

The orders were allegedly given to the then chief secretary of Balochistan who referred the case to Services and General Administration Department (S&GAD), as the authority to approval postings and transfers of secretariat staff.

Ironically, the reference also stated that in the August of 2005, the Ministry of Interior addressed a letter to the chief secretary of Balochistan regarding Dr Iftikhar’s services being required in FIA.

In September of 2005, the Ministry of Interior issued a notification to appoint Dr Iftikhar as Assistant Director in the FIA. In the April of 2006, Dr Iftikhar was promoted to the position of Deputy Director in FIA.

After being promoted in FIA, it is alleged that a campaign was launched to recruit Dr Iftikhar in the police service.

The reference also mentions that in the May of 2006, the Ministry of Interior issued a letter to Commandment National Police Academy, Islamabad to attach Dr Iftikhar for field training along with under training ASPs.

A few days later the Ministry of Interior issued another letter which stated that after the completion of Dr Iftikhar’s training at National Police Academy, the services of the trainee be made available to Punjab Police.

In the mean time the Prime Minister Secretariat was allegedly approached to permanently induct Dr Iftikhar as an employee of the Police Service of Pakistan. However, his permanent recruitment required an amendment in the Police Service of Pakistan Rules 1985, which could only be introduced through president’s approval. The authorities claim that the chief justice exerted immense pressure on the Prime Minister Secretariat to ensure his son’s permanent induction in the police force.

The aforementioned charges, along with other cases, brought about the suspension of Iftikhar Muhammad Chaudhry in March 2007. It triggered an unprecedented wave of protests and resignations by lawyers and judges including that of Justice Jawwad S Khwaja, who is now a part of the judges’ panel in Arsalan Iftikhar’s graft case.

The reference and charges filed by former president Musharraf were challenged by the chief justice in the Supreme Court of Pakistan as he believed that the Supreme Judicial Council will manoeuvre the judgment according to the president’s will.

Chaudhry was represented by a team of five lawyers including Aitzaz Ahsan, Ali Ahmad Kurd and Tariq Mehmood. He was reinstated on July 20, 2007 based on the ruling given by the thirteen-member bench of Supreme Court of Pakistan headed by Justice Khalil-ur-Rehman Ramday. The irony remains that Aitzaz Ahsan, who defended Prime Minister Yousuf Raza Gilani in the contempt of court case filed against the premier, was one of the most important members of CJ’s team. It is important to mention that Ahsan and his campaign played an important role in his reinstatement.

Shortly afterwards, Mushraraf imposed emergency in Pakistan, during which chief justice and his family were under house arrest. The house arrest and the anarchy resulted in the famous lawyers’ movement and the long march against the unpopular dictatorial regime of Pervez Musharraf.

I just want to mention that Musharraf son and daughter both were doing jobs and not business like every other politician offspring. they remined aside during the whole tenure of musharraf.

I concur! Dr. Ch. is a total failure and his brain is so thick that it is hard to accept that he did all the dealings with Malik and others on his own...CJ has to be behind all the coaching and honorable justice has to be the mastermind of the whole scheme. Arsalan could not even spell "success" right in BMC. Besides "C" in HSSC he scored less than 20% in key subjects of his Civil services selection exams. But guess what, "hon" justice got him through all the tick and thins of the process. We used to say "Baap ho tu aisa, warns Allah banday ko thora damage zaroor dey" :) The suo moto by Iftikhar is not to prevail justice, but rather to prevent and manupilate justice. He is like that. Funny thing is all the media except for AA and KK are all praise for suo moto but no one is asking why Malik's financials are being scrutinized and not Arsoo's by the order of the "hon" CJ? Credit is given to CJ for throwing the bad egg out of the house, but may I dare to ask how come the CJ did not know what was going on. Anyways, let's be honest. As ex-senator Mashooq used to say there should be equal opportunity for all regardless of race, gender and province to indulge in the sweet waters of corruption.... CJ has all the rights to shower the bounties of his post and stature on his son and make hay while CJ sits in that chair which should be the symbol of justice and honor..... May Allah bless the people of Pakistan with a tiny bitty moral courage to see and say wrong when they see a wrong deed is carried out without any prejudice.

It might be true that Arsalan was floating with money and his father (family) could have taken notice. However, most important point is that had father offered any out of the way concession to malik riyaz. Big question is that why malik riaz was seeking undue favour? Now this case should meet its final judgment and all the links should be established. I strongly wish for the justice at all levels.

Well you did not know that our President did not believe in the inquiry of Pakistani experts so they asked UNO to probe in the assassination of the widowed husband's wife, they went ahead one more step and chased the ex president and asked help from the hiding place of the ex president in UK their famous Scotland Yard, to uncover the conspiracy for such a tragic event. To date, the findings are in abeyance.

This article wrongly claims that charge sheet against Chaudry by Musharaf was proven wrong. Fact is that, it never got investigated. Brothers judges and political movement against dictator allowed Chaudry to not only get away, but also got reinstated.

No suo moto on May 2012 killings in Karachi ? our so called justice system can promptily notice slap of waheeda shah ? the son's activity was continued for last many year from Doctor of provincial government to Police of Federal Governemnt and greed of wealth till date has no limits to end for a son of Pakistani beuracracy but could not be noticed by our Justice Sahib because he was busy in doing Justice with Pakistan. They all are same and he will be left unpunished and honoured after this event. Long live Pakistani Powerfull beurucracy and politicians

Dr Arslaan is no doubt guilty but Ch.Iftikhar is also not innocent in this regard. He (Mr Iftikhar) abused his status and helped his son in every unlawfull matters. It is qiute evident from the recoed.No chance of fair trial against Dr Arsallan.

Saddened by the latest deveopment! If these allegation are proved right, it will be a very big blow to Pakistan. Looking from outside, there was a suspicion that the SC was a little harsh towards the government . The opposition constantly eulogising the CJ again added to the suspicion. But never in my dreams would I have thought that the CJ would have a son who could be corrupt and the CJ would be brought to his knees because of that! I do not care so much for the CJ's predicament, he is just one man in a much larger scheme of things! I feel sorry for Pakistanis - millions hopes have been dashed! Thier icon for morality and justice now has lost its halo!.

What was CJ doing when his son was having fun right under his nose? could he not notice his lavish life style? who helped him to become a doctor? who helped him to join police, FIA and what not, he is playing innocent now. All political parties are still trying to play safe, by not going against CJ, it is plain truth that his son is involved in some way with Malick Riaz, but who introduced him to success through back doors. Nothing will come out of it. It will be labeled as conspiracy against Judiciary.

The most disturbing part is the way he appeared in the court. There was no sign of any regret or shame on his face. Even in one of picture he was waving victory sign. Is it not telling us something real wrong went in his up-brining?

A number of unanswered questions abound this new scandal in an otherwise tainted history of our country. As noted by a number of persons, it is impossible to believe that the CJP was unware of his son amassing all the wealth through illegal means. Also, a pertinent question to ask is why is Riaz Malik making these allegations at this stage? Is a hidden, sinister agenda behind all this? Could this possibly have any link with the indictment of the PM or the SC taking suo moto action against missing persons? From a legal perspective whilst the CJP cannot be made accountable for the wrongdoings committed by his son unless he is proved to hae derived any benefits (hard to see how he could not have) but form a moral and ethical perspective IF it is either established that his son did indeed take the alleged bribes from Riaz Malikm or in case the people do not believe his innocence in the matter, then he must resign immediately.Taking suo moto action against the son may sound like our reliving the era of Hazrat Omer when he supposedly took his son to task before a court for some crime, but considering that we are living in times when we Pakistanis have lost all hope in justice or are too confused to know what to believe, if this storm does not blow over, the CJP will need to make a call on whether or not to resign and that too very soon.

If Chief Justice of Pakistan say that he is not aware about Dr.Arsalan's admission in Bolan College being a C Grader, his postings in FIA, Police depatments, quick promotions, accumulaton of wealth, then he has no right to hold the supreme status of Chief Justice of Pakistan. He MUST RESIGN IMMEDIATELY.

Arsalan Iftikhar submitted his statement today, he denied having any link to Maliks, but court did not ask him to submit his income tax statement, his source of income, his trips to London, his stay in expensive hotels, his shopping spree, as had been asked of Maliks. Is it selective justice?

The case relating to Dr Arsalan Iftikhar goes back to 2006. No one bothered to rake up this case while the CJP was hauling the politicians over the coal in NRO,Swiss Letter, Contempt and Memogate cases. The moment he took up the Disappeared persons case and summoned the IG of FC, the case has come centre stage. Aabpara at work?

Father is the chief Justice , who knows all the places in country , where corruption is rampant but he is ignorant about his son , who is living lavish life on the money of other people. Chief Justice said in statement,that he does not know what is his son's business,what a strange father. President Musharraf was right but ignored by media,as Mr Arsalan and Iftikhar Choudhary was using the SC office for there own wish and comfort. very comprehensive article written here in Dawn,which clearly show Mr Iftikhar and his son's character. CJ and justice jawwad shall leave office to clean the judiciary from all this greedy people,and if interested shall come through election from Nawaz Group.
